LEGAL NOTICE

PUBLIC MEETINGS OF THE PALM BEACH COUNTY CANVASSING BOARD FOR THE NOVEMBER 4, 2008 GENERAL ELECTION

In accordance with the Sunshine Law of Florida, all Canvassing Board meetings are open to the public.

The sealed absentee ballots received prior to 8:00 a.m. Wednesday, October 29, 2008, for the General Election will be available for public inspection from 8:00 a.m. until 9:00 a.m. on Wednesday, October 29, at the Supervisor of Elections Tabulation Facility, 3200 Belvedere Road, #1169, West Palm Beach, FL 33406. Immediately afterwards, the Supervisor of Elections Staff will commence the opening and processing through the tabulating equipment of those absentee ballots and any absentee ballots subsequently received, until 6:00 p.m. or thereafter as needed, and resuming on Thursday, October 30, 9:00 a.m., and continuing from day to day as needed until completed. Unless otherwise posted, the opening and processing of the absentee ballots received by November 4, 2008 will take place at 3200 Belvedere Road, #1169, West Palm Beach, FL 33406. Any absentee ballots received after 9:00 a.m. Wednesday, October 29, 2008 will be available for public inspection until opened. Those wishing to inspect any remaining unopened absentee ballots must make a timely request to do so, and be readily available to promptly make such an inspection upon the Supervisor of Elections daily receipt of such absentee ballots prior to their opening. 

At 10:00 a.m. on Wednesday, October 29, 2008, the Canvassing Board will convene and remain in session from day to day as needed for canvassing of the absentee ballots and other Board business at the Supervisor of Elections Tabulation Facility, 3200 Belvedere Road, #1169, West Palm Beach, FL 33406, or such other location as may be posted, and will continue to meet at that facility or such other location as may be posted until 7:00 p.m. or the close of the polls on November 4, 2008, and thereafter the Canvassing Board will remain in session at that facility on the evening of November 4, 2008, or such other location as may be posted, to further canvass absentee ballots, provisional ballots, precinct returns, and take up other Board business. Thereafter the Palm Beach County Canvassing Board will remain in session at that facility, or such other location as may be posted, from day to day to complete canvassing duties, testing of the tabulating equipment if required, and other Board business until the results of the Election are obtained, finalized, recounted if required by Florida Statutes 102.141 and/or 102.166, certified, and audited pursuant to Florida Statute 101.591.

It may become necessary for the Canvassing Board to reconvene at times, dates, or places other than those specified above. If so, the location, date and time will be announced at the conclusion of the preceding or pertinent meeting and posted at the Supervisor of Elections Offices. 

NOTE: Section 101.68(2)(c)2, Florida Statutes, states that if any elector or candidate present believes that an absentee ballot is illegal due to a defect apparent on the voter’s certificate, he or she may, at any time before the ballot is removed from the envelope, file with the canvassing board a protest against the canvass of that ballot, specifying the precinct, the ballot, and the reason he or she believes the ballot to be illegal. A challenge based upon a defect in the voter’s certificate may not be accepted after the ballot has been removed from the mailing envelope.

NOTE: Section 286.0105, Florida Statutes, states that if a person decides to appeal any decision by a board, agency, or commission with respect to any matter considered at a meeting, he or she will need a record of the proceedings, and that, for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. It shall be the responsibility of any person needing such a record to arrange for and obtain such a verbatim record at his/her own cost and expense.

In accordance with the Americans with Disabilities Act (ADA), if any person with a disability, as defined by the ADA, needs special accommodation to participate in these meetings, then not later than two business days prior to the pertinent meeting or meetings, he or she should contact the Supervisor of Elections at (561) 656-6200.
